We are confident that our customers will be satisfied with our products but we will refer to this document in the unlikely event of a problem or dispute.
In ordering custom products from Lanyard Lab and in using LanyardLab.com you are deemed to have read and agreed to the following Terms and Conditions:
The following terminology applies to these Terms and Conditions: "The Company", "Lanyard Lab", "Ourselves", "We" and "Us", refers to Falkor Labs, LLC DBA Lanyard Lab. "Customer", "You" and "Your" refers to you, the person accessing LanyardLab.com and/or ordering custom products from Lanyard Lab and accepting Lanyard Lab's Terms and Conditions. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Before ordering custom lanyards from Lanyard Lab, the Customer will receive an all-inclusive price quote containing any and all design, manufacturing, production, setup, and shipping fees to be paid by the Customer for their order. Lanyard Lab guarantees that all orders of 5,000 custom lanyards or fewer will not include charges for shipping. Shipping costs for orders of more than 5,000 custom lanyards may be included on the price quote(s) sent to the Customer prior to the order being placed. Alternately, Lanyard Lab may, at their discretion, offer free shipping on orders of 5,000 or more custom lanyards.
Prices for custom lanyards offered on LanyardLab.com, over the phone by a Lanyard Lab representative, or via e-mail from a Lanyard Lab representative are incorporated into this agreement by reference. All prices are in United States dollars (USD). Prices and products may change at any time at the discretion of Lanyard Lab and without notice. In no event shall a quote be good for more than 45 days unless approved in writing by Lanyard Lab.
When possible and appropriate, a price quote sent to the Customer is accompanied by a digital proof of the Customer's custom lanyard design. A digital proof is an on-screen representation of what the Customer's custom lanyard design will look like when produced. Digital proofs are not drawn to scale and are intended only as guides for the Customer to understand how their design ideas will be incorporated onto custom lanyards. If specific text or image dimensions and/or spacing are required in creating the Customer's custom lanyards, the Customer must supply them to Lanyard Lab prior to the start of production on the Customer's order.
Due to variations in computer monitors, Lanyard Lab cannot guarantee the complete accuracy of colors seen on-screen on LanyardLab.com or on any digital proofs created for the Customer. To achieve the best possible on-screen representation of colors, Lanyard Lab uses the PANTONE® Matching System (PMS) to produce both the digital proofs and the custom lanyards. The on-screen representation of the PMS colors is, in general, close to the final product. Lanyard Lab is not liable or responsible if the Customer's computer monitor is faulty or improperly configured and does not display colors correctly.
Customers uploading or otherwise supplying designs to Lanyard Lab for use in production of custom lanyards must either own or have explicit permission to use said designs. Customers must abide by United States trademark and copyright law in creating their custom lanyard designs. Customers may not use images of celebrities, corporate products or logos, or any other text, images, graphics, or design taken from any Web sites, publications, or other media without permission. Lanyard Lab is not held liable or responsible for verifying ownership of any designs supplied by Customers and assumes that any and all designs sent to Lanyard Lab by the Customer have been supplied with proper legal permission.
Lanyard Lab reserves the right to cancel any order for any product that we learn will violate a third party's intellectual property rights. The Customer will be notified upon an order's cancellation.
Lanyard Lab has the sole discretion to reject any design that it considers obscene, defamatory, portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, disability or national origin, containing explicit sexual content or is otherwise determined to be inappropriate for Lanyard Lab to produce.
By visiting LanyardLab.com, you agree not to duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of this Web site.
Lanyard Lab accepts online payments via credit card or debit card. All online payments are securely transmitted using Secure Socket Layer ("SSL") technology. In addition, Lanyard Lab accepts cash, checks, and money orders by mail. Lanyard Lab processes payments immediately upon receipt of payment information.
Unless otherwise specified, payment for custom lanyard orders to Lanyard Lab is made in full prior to the start of production. A mailed check must clear the bank before production of its corresponding order may begin. Lanyard Lab reserves the right to make individual arrangements with Customers for alternate payment methods, timing, or procedures.
In general, Lanyard Lab also accepts purchase orders from schools, universities, and government organizations. Lanyard Lab reserves the right to refuse a purchase order from any entity. Purchase orders are generally issued on Net 30 terms (payment due within 30 days of invoicing). Past-due orders are subject to 5% interest, compounding monthly.
Production times vary between custom lanyard styles. Durations listed on LanyardLab.com or given by Lanyard Lab representatives by telephone or e-mail include the production of custom lanyards only. Delivery time of orders is not included in listed times, except where specifically noted, but can be estimated by Lanyard Lab representatives. Products produced by Lanyard Lab are manufactured outside of the United States. Lanyard Lab guarantees its listed production times but cannot guarantee delivery dates by third-party services. Lanyard Lab is not responsible for shipping delays outside of its control including, but not limited to, equipment failure, transportation delays, or acts of God. Lanyard Lab will keep Customers informed of any delays in shipping.
If the Customer has a specific date by which they must receive their custom lanyard order, Lanyard Lab will make every effort to attempt to ensure that its production schedule provides enough time for third-party delivery services to deliver the Customer's order on or before the Customer's necessary due date. Once an order has been shipped, Lanyard Lab does not assume responsibility of the delivery service to deliver the shipment on time.
All lanyards produced by Lanyard Lab are customized and special ordered for the Customer. If the custom lanyards received by the Customer materially differ from the order description, do not reasonably resemble the corresponding digital proof, or are somehow materially flawed in production, the Customer's sole remedy shall be to exchange the custom lanyards for new, correctly-produced lanyards. Customer must notify Lanyard Lab of the error within 14 days of receipt of the order. The Customer may be asked to send a photograph or physical sample of the error, or return the complete order for verification prior to the exchange. The original production time will apply for the replacement lanyards. If the Customer's lanyards cannot be remade correctly before the Customer's original deadline, a full refund will be issued upon Lanyard Lab's receipt of the incorrectly-produced lanyards. Lanyard Lab may, in its absolute discretion on occasion, decide to issue a refund without requiring the Customer to return the original lanyards.
Lanyard Lab is not responsible for typographical or design errors made by the Customer in supplying the text or design for use on their custom lanyards. All ordered custom lanyards designs are approved by the Customer by way of a digital proof. Produced lanyards are based on this approved design.
If an order of custom lanyards is correctly produced, Lanyard Lab is unable to accept returns or issue refunds, due to the custom nature of our products, Lanyard Lab cannot cancel an order once production has begun.
Lanyard Lab will not share or sell any Customer's address, telephone number, e-mail address, or payment information to organizations outside of Lanyard Lab and its subcontractors. For every order placed, Lanyard Lab provides information about the Customer and the Customer's order to its subcontractors in order to produce the Customer's custom lanyards. Lanyard Lab may also share information about the Customer or the Customer's order with any relevant organizations to determine if the use of any used Licensed Marks are prohibited. Lanyard Lab reserves the right to use any Customer's name, related organization name, and/or produced lanyard design for promotional, informational, or marketing purposes on LanyardLab.com or in any other form of media, unless, prior to ordering, the Customer requests in writing that their custom lanyard design not be used by Lanyard Lab for promotional purposes.
Lanyard Lab reserves the right to change these Terms and Conditions from time to time as it sees fit. Your continued placing of orders with Lanyard Lab and/or use of the Web site signifies your acceptance of any adjustments to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. You are therefore advised to re-read this statement on a regular basis.
The information and product listings on this Web site may contain typographical errors, inaccuracies, or omissions and may not be complete or current. Such errors, inaccuracies or omissions may relate to price or to product description or availability. Lanyard Lab reserves the right to correct any errors, inaccuracies or omissions and to change or update information or content at any time, each without prior notice (including after you have placed/submitted your order). Lanyard Lab also reserves the right to refuse or cancel any price quotes or orders containing any error, inaccuracy, or omission, even after an order has been submitted and/or payment has been received. Lanyard Lab will promptly issue any necessary refunds or credits upon discovery of any errors related to the Customer's order.
Lanyard Lab will be responsible for acting only on those instructions sent to Lanyard Lab that actually are received and does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. Lanyard Lab is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. Lanyard Lab is not responsible should you give incorrect instructions or if your credit-card payment is not processed by your credit card company.
The information and materials contained in this Web site, including text, graphics, links or other items, are provided "as is", "as available". Lanyard Lab does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. You agree to indemnify Lanyard Lab and its affiliates and to hold them harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of LanyardLab.com or Lanyard Lab's products, your violation of these Terms and Conditions, or your violation of any rights of another, including, but not limited to, trademark or copyright infringement.
You agree that you will use this Web site and any of Lanyard Lab's products ordered in accordance with all applicable United States federal, state and local laws, statutes, regulations and ordinances and will not take any action that harms or violates the rights of any person or entity.
These Terms and Conditions and your relationship with Lanyard Lab shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any conflict of law provisions. You and Lanyard Lab agree to submit to the personal and exclusive jurisdiction of the courts located within Orange County, Florida. This Agreement constitutes the entire agreement between you and Lanyard Lab and supersedes all other communications, written or oral, with regard to the Web site and services provided by Lanyard Lab.
